The Gist

We (Themology) build WordPress plugins and themes to help store owners succeed. We hope you love our products as much as we love creating them. These Terms of Service ("Terms") describe our commitments to you, and your rights and responsibilities when using our services.Please read them carefully. If you don't agree to these Terms, please don't use our services.

1. Our Services

These Terms govern your access to and use of the products and services we provide, including:
Free Plugins and Themes: Open-source products available on WordPress.orgPremium Plugins and Themes: Paid products available exclusively on themology.comThe Themology Website: Including documentation, support, and account managementDonations: Voluntary contributions to support our open-source work
By accessing or using any part of our Services, you agree to be bound by all of these Terms and all other policies we publish, including our Privacy Policy, Refund Policy, and Support Policy.

2. Who's Who

"You" means any individual or entity using our Services. If you use our Services on behalf of another person or entity, you represent that you're authorized to accept these Terms on their behalf."We," "us," and "Themology" refers to Themology and its operators.

3. Your Account

When you purchase premium products or make donations, an account may be created for you through our payment processor, Lemon Squeezy. You can also create an account on Themology to manage your purchases and subscriptions.You agree to:
• Provide accurate and complete information• Keep your account information current• Maintain the security of your account credentials• Notify us immediately of any unauthorized access
You're solely responsible for all activity under your account.

4. Minimum Age Requirements

Our Services are not directed to children. You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use our Services or make purchases. If you're under 18, you may only use our Services under the supervision of a parent or legal guardian who agrees to these Terms.

5. Fees, Payment, and Renewal

a. Premium ProductsSome of our plugins and themes are offered for a fee ("Premium Products"). By purchasing a Premium Product, you agree to pay the specified fees. Prices are displayed on each product page and may change at any time, though changes won't affect existing subscriptions until renewal.
b. Automatic RenewalPremium Products are sold as annual subscriptions that renew automatically. By purchasing, you authorize us to charge the then-applicable renewal fee to your payment method each year until you cancel. You'll receive an email reminder before each renewal. You can cancel anytime from your Themology account or Lemon Squeezy account.
c. TaxesPrices may or may not include applicable taxes depending on your location. You're responsible for paying all applicable taxes. Our payment processor (Lemon Squeezy) handles tax calculation and collection where required by law.
d. Payment ProcessingAll payments are processed by Lemon Squeezy, which uses Stripe and PayPal. By making a payment, you also agree to Lemon Squeezy's Terms of Service. We are not responsible for issues arising from the payment processor's services.
e. RefundsWe offer a 30-day money-back guarantee for Premium Products. Please see our Refund Policy for complete details on refunds, subscription cancellations, and the refund request process.

6. Donations

Donations are voluntary contributions to support our open-source development work. By making a donation, you acknowledge that:
• Donations are generally non-refundable (see our Refund Policy)• Donations do not entitle you to any specific products, services, or priority support• Donations are not tax-deductible as Themology is not a registered non-profit

7. Licensing and Use

a. GPL LicenseOur plugins and themes are licensed under the GNU General Public License (GPL) v2 or later. You're free to use, modify, and distribute the code in accordance with the GPL. However, the GPL license applies only to the plugin/theme code itself.
b. Premium Product AccessWhen you purchase a Premium Product, you receive:
• Access to download the product• Updates for one year from purchase date• Priority support for one year from purchase date
After your subscription expires, you may continue using the product, but you won't receive updates or support unless you renew.
c. RestrictionsWhile GPL allows redistribution, you may not:
• Claim our products as your own creation• Remove or alter copyright notices or attributions• Use our trademarks, logos, or branding without permission• Redistribute premium products with our support/update services

8. Support

We provide support for our products as described in our Support Policy. In summary:
Premium Products: Priority support via our support form for customers with active subscriptionsFree Products: Community support via WordPress.org forums
Support does not include customization, third-party plugin conflicts, or general WordPress assistance.

9. Your Responsibilities

You represent and warrant that your use of our Services:
• Will comply with all applicable laws and regulations• Will not be for any unlawful purpose• Will not infringe on intellectual property rights• Will not attempt to gain unauthorized access to our systems• Will not interfere with or disrupt our Services• Will not reverse engineer our Services (except as permitted by GPL)
You're responsible for testing our products in a staging environment before deploying to production, and for maintaining backups of your website.

10. Intellectual Property

The Themology name, logo, website design, documentation, and other non-code content are our intellectual property and may not be used without our permission.Plugin and theme source code is licensed under GPL and may be used, modified, and distributed according to that license. However, this does not grant rights to our trademarks or branding.

11. Third-Party Services

Our Services may integrate with or require third-party services, including:
Lemon Squeezy for payment processing Stripe and PayPal for payment methods• WordPress and WooCommerce as the platform for our products
Your use of third-party services is subject to their respective terms and privacy policies. We're not responsible for third-party services and make no warranties about them.

12. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that our Services will be error-free, uninterrupted, secure, or compatible with all WordPress configurations, plugins, themes, or hosting environments.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEMOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM:
• Your use or inability to use our Services• Any errors, bugs, or vulnerabilities in our products• Unauthorized access to your data or systems• Third-party services or content
Our total liability for any claims under these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $50.

14. Indemnification

You agree to indemnify and hold harmless Themology, its operators, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
• Your use of our Services• Your violation of these Terms• Your violation of any applicable law or regulation• Any content you publish using our products

15. Dispute Resolution

If you have a dispute regarding a purchase, subscription, or any of our Services, please contact us before initiating a chargeback or legal action. We'll make reasonable efforts to resolve the issue directly with you.Filing chargebacks without first attempting to resolve the issue with us may result in termination of your access to our Services.

16. Termination

We may terminate or suspend your access to our Services at any time, with or without cause, if we believe you have violated these Terms or engaged in fraudulent or abusive behavior.You can stop using our Services at any time. To cancel a subscription, visit your Themology account. Upon termination, your right to access premium downloads and support ends, but you may continue using any products you've already downloaded (subject to GPL).

17. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we'll notify you by email or by posting a notice on our website before the changes take effect. Changes won't apply retroactively.By continuing to use our Services after changes take effect, you agree to the revised Terms. If you don't agree to the changes, you should stop using our Services.

18. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions in your country of residence.

19. Miscellaneous

These Terms, together with our Privacy Policy, Refund Policy, and Support Policy, constitute the entire agreement between you and Themology regarding our Services.If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect. Our failure to enforce any provision doesn't waive our right to enforce it later.We may assign our rights under these Terms. You may not assign your rights without our written consent.
